GolfTrip Terms of Service

Below are the Terms of Service ("Terms") between GolfTrip.ai (hereinafter “GolfTrip”, “we”, “us”, and “our”) and you, our customer, (hereinafter, “you”, “the traveler”). These Terms regulate your use of our services and website. By accessing or using our services, you agree to abide by these Terms.

  1. Acceptance of Terms

By using our services or making a booking, you agree to the following Terms, which form a legally binding contract between you and GolfTrip. Please read and understand these Terms, along with any communicated rules and guidelines. If you have any questions, please contact us before booking. Note that these terms include waivers of liability and class action waivers. If you do not agree to these Terms, you cannot make any bookings with us.

If you are booking as a group, the group leader is responsible for sharing these Terms with all members of the group and is financially liable for the booking. We are not liable for any failure by the group leader to share these Terms with all travelers.

These Terms, along with our Privacy Policy and any other referenced terms and policies, constitute the entire agreement between you and GolfTrip and replace any previous agreements, understandings, negotiations, or discussions, whether oral or written. No waiver of any provision in these Terms shall be considered a waiver of any other provision, unless expressly provided otherwise. Please note that supplier terms and conditions apply to bookings.

By using our services and website, you represent and warrant that: (a) you are at least 21 years old and can legally enter into obligations; (b) you have legal authority to act on behalf of others and accept these terms on their behalf; and (c) the information you provide, as well as that of your group, is accurate and truthful.

  1. Our Services and Accuracy

GolfTrip offers booking services for tee times, certain lodging, dining reservations, and other travel services. Please note that we cannot book transportation or accommodations such as Airbnb or VRBO. While we strive to provide accurate and up-to-date information, we cannot guarantee the availability or accuracy of bookings made through our services. Changes or cancellations beyond our control are not our responsibility, and we will not be held liable for such changes.

We aim to provide accurate descriptions of products and services on our website, but we do not guarantee the accuracy, completeness, reliability, currency, or error-free nature of these descriptions.

Additionally, GolfTrip tools may utilize artificial intelligence to generate certain content. We cannot guarantee the accuracy, completeness, or reliability of the data provided by these tools and will not be held liable for any discrepancies or errors in the information.

 

  1. Pricing

GolfTrip provides prices for tee times, lodging, dining reservations, and other services, information provided from third party suppliers. The prices may not be exact and are subject to change. We do not collect any payments with bookings but may require your payment method information to secure reservations. You, the Traveler, are responsible for making payments directly to the third-party suppliers. The payment terms and conditions of these suppliers are separate and independent from GolfTrip. GolfTrip is not responsible for price changes, refunds, or payment issues. GolfTrip is not responsible for any additional add-on expenses incurred by the Traveler. GolfTrip is not liable for inaccuracies in payment information or supplier payment processing. Failure to make payments as required by the suppliers may result in the cancellation or alteration of your bookings. GolfTrip shall not be liable for any such consequences arising from failure to make timely payments.

  1. Cancellations or Modifications

To modify, transfer, or cancel your group booking, the individual who made the reservation must inform us in writing via email. GolfTrip will try to make changes with the supplier, but their cancellation and modification policies apply. If we can't make changes, it is the responsibility of the traveler. GolfTrip facilitates bookings but does not handle payments. The supplier may charge additional fees for cancellations or modifications, for which we are not liable.

'Force Majeure' refers to unforeseeable events beyond our control, such as wars, disasters, epidemics (like COVID-19), or government restrictions. In such cases, we are not liable for canceled bookings. You're responsible for payments as per the supplier's terms.

GolfTrip is not responsible for airfare cancellations or delays. Additionally, golf courses may modify operations due to adverse weather conditions. Please adhere to each course's inclement weather policy.

  1. Release

GolfTrip utilizes Third Party Providers to arrange golfing, lodging, and other trip-related services. We are an independent contractor and not an employee or representative of these providers. GolfTrip does not own, manage, operate, supervise, or control transportation, vehicles, golf courses, hotels, restaurants, or any other service entities. Third Party Providers are independent contractors and responsible for their interactions with you and any resulting claims, injuries, damages, or costs. You hereby release GolfTrip from any and all such Claims. If you are a California resident, you waive California Civil Code Section 1542, which pertains to unknown or unsuspected claims. This waiver extends to any similar laws in other jurisdictions.

  1. Assumption of Risk

The traveler acknowledges and accepts inherent risks associated with their trip, including sports-related risks. These risks include, but are not limited to, injuries or death from various factors such as motor vehicle accidents, animals, hazards on roadways, slips and falls, criminal acts, government actions, accidents on golf courses, consumption of alcohol or tainted food, exposure to elements, negligence of self or others, encounters with insects or animals, accidents or illness in remote areas without medical services, fatigue, known or unknown medical conditions, lack of proper training of third-party providers, limited access to medical evacuation or supplies, and adequacy of medical attention. The traveler understands that the list of risks is not exhaustive and that unforeseen risks may arise. The traveler willingly accepts these risks, including the risk of infection, illness, or death. The traveler assumes full responsibility for any illness, injury, or death and releases GolfTrip from any claims associated with the trip, including claims of third-party negligence. The traveler agrees not to sue or participate in any lawsuit against GolfTrip. This agreement applies to heirs, representatives, and assigns. The terms of this agreement remain valid even after the termination or cancellation of the contract.

  1. Covid-19 Release

By booking a trip, you acknowledge the contagious nature of COVID-19 and assume the risk of exposure, infection, and related consequences for yourself and any minors traveling with you. This includes personal injury, illness, disability, and death, even if unforeseeable. You understand that such risks are inherent in travel and beyond GolfTrip's control.

Due to the uncertainty of travel, your trip may be postponed, canceled, or itinerary changes may occur without refund. Quarantine requirements and proof of vaccination or negative testing may also apply in certain locations. It is your responsibility to understand and comply with these requirements. GolfTrip is not liable for sickness, cancellation, or interruptions.

You, on behalf of yourself and minors traveling with you, release and hold harmless GolfTrip, its members, officers, agents, employees, and suppliers from any claims, damages, losses, or liabilities related to COVID-19, whether caused by the negligence of the released parties or otherwise. This release remains valid even after contract termination or cancellation.

  1. Complaints During Your Trip

If you have a complaint or experience any problems during your trip, please inform the supplier concerned as soon as possible. While we do our best to assist in any way possible, GolfTrip may not be able to rectify any booking issues or changes while on your trip.

  1. Indemnification

Travelers must adhere to behavior guidelines set by GolfTrip and our suppliers. Suppliers have the right to remove any traveler who endangers themselves, others, or disrupts the trip. In such cases, GolfTrip is not liable for any incurred costs.

The traveler agrees to indemnify and hold GolfTrip, its officers, directors, employees, and agents harmless from any expenses, losses, liabilities, damages, and costs, including legal fees, resulting from the traveler's breach of this agreement or any damage caused during the trip.

The lead name on each booking is responsible for their group's actions during the trip and may be liable for costs due to group negligence or misconduct.

  1. Insurance

It is your responsibility to ensure that any insurance purchased by you is adequate for your needs. GolfTrip does not check insurance policies. We do not accept any liability for any possible loss that you suffer as a result of your failure to take out an adequate insurance policy.

  1. Special Requests and Medical Problems

Please inform us of any special requests at the time of booking. Note that we cannot guarantee the fulfillment of these requests. Confirmation or inclusion of a special request in your documentation does not guarantee its fulfillment, as it is subject to availability by the supplier.

If you or any member of your party requires assistance due to a medical problem or disability, it is your responsibility to notify us before booking or as soon as possible after diagnosis. We will inform the supplier, but we are not responsible if the supplier fails to meet these specifications.

  1. International Travel Documents

You are responsible for having the correct travel documentation for your destination. We are not liable if you are denied transportation or entry to a country due to your failure to carry the necessary documents. Please consult government websites to ensure compliance with entry requirements, including COVID-19 guidelines and local travel laws such as medical tests and tracking. If you choose to travel to a country with a travel warning or advisory, GolfTrip is not liable for any resulting damages or losses.

  1. Changes to these Terms

GolfTrip reserves the right, in our sole discretion, to change these terms and conditions at any time. Updated versions of the terms and conditions with material changes will be provided to you and are effective immediately upon receipt to you via email. Your continued use of our services including continuing to use or maintain your booking after any changes to the terms and conditions constitutes your consent to the changes.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in New Jersey.
