GolfTrip LLC Terms of Service & SMS Messaging Terms

1. Acceptance of Terms
By accessing or using GolfTrip LLC ("GolfTrip," "we," "our," or "us"), including GolfTrip.ai and related services, you agree to these Terms. If you do not agree, do not use our services.
2. Eligibility
You represent that you are at least 18 years old (21 where required by law), have legal capacity to enter into this agreement, and, if booking on behalf of others, have authority to bind those travelers.
3. Services
GolfTrip facilitates golf trip planning and booking coordination with independent third-party suppliers including golf courses, lodging providers, restaurants, transportation providers, and other travel vendors. Unless expressly stated, GolfTrip is not the merchant of record for supplier services.
4. Supplier Relationships
All reservations remain subject to the supplier's own pricing, availability, payment, cancellation, refund, and operating policies. GolfTrip is not responsible for supplier errors, schedule changes, closures, insolvency, or service failures.
5. Pricing
Pricing displayed is believed accurate but is subject to change until confirmed by suppliers.
6. AI & Website Information
Certain website features may utilize artificial intelligence. AI-generated recommendations are provided for informational purposes only and are not guaranteed to be accurate.
7. Cancellations & Modifications
Modification and cancellation requests must be submitted by the booking contact. Supplier policies govern refunds and cancellation fees.
8. Force Majeure
GolfTrip is not liable for delays or cancellations caused by events beyond its reasonable control, including severe weather, pandemics, strikes, terrorism, governmental action, supplier failure, or natural disasters.
9. Assumption of Risk
Travel and golf activities involve inherent risks. You voluntarily assume all risks associated with participation.
10. Release & Limitation of Liability
To the fullest extent permitted by law, GolfTrip shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of our services. GolfTrip's total liability shall not exceed fees paid directly to GolfTrip for the affected booking.
11. Indemnification
You agree to indemnify and hold harmless GolfTrip LLC, its owners, employees, contractors, and affiliates from claims arising from your breach of these Terms or misuse of our services.
12. Intellectual Property
All GolfTrip trademarks, logos, software, website content, itineraries, and proprietary tools remain the exclusive property of GolfTrip LLC.
13. Privacy
Use of our services is subject to our Privacy Policy.
14. SMS Messaging Terms
By voluntarily providing your mobile phone number and expressly opting into SMS communications from GolfTrip LLC, you agree to receive recurring automated and non-automated text messages.
Message types may include:
• Trip confirmations
• Reservation updates
• Tee time notifications
• Itinerary reminders
• Customer support communications
• Account notifications
Message frequency varies based on your interactions with GolfTrip.
Message and data rates may apply.
Consent to receive SMS messages is not a condition of purchasing any goods or services.
You may opt out at any time by replying STOP, END, CANCEL, QUIT, UNSUBSCRIBE, or STOPALL. You will receive one confirmation message and no additional SMS messages unless you opt in again.

Wireless carriers are not liable for delayed or undelivered messages.
15. SMS Consent
SMS consent is collected directly by GolfTrip LLC. Consent is never obtained from third-party lead providers or affiliates. Users must provide affirmative consent before receiving SMS communications.
16. No Sale or Sharing of Mobile Information
GolfTrip LLC does not sell, rent, trade, or share mobile phone numbers, SMS consent records, or opt-in data with third parties or affiliates for their own marketing or promotional purposes.
We may use trusted service providers solely to facilitate message delivery, customer support, or platform operations. Those providers may use your information only to perform services on our behalf.
17. A2P 10DLC Compliance
GolfTrip complies with applicable carrier rules governing Application-to-Person (A2P) messaging.
By opting into SMS communications you acknowledge:
• You provided direct consent to GolfTrip LLC.
• Consent is separate from acceptance of these Terms.
• Consent is not a condition of purchase.
• Mobile numbers and SMS consent are never sold or shared for marketing purposes.
• You may revoke consent at any time by replying STOP.
18. Governing Law
These Terms are governed by the laws of the State of New Jersey.
19. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
20. Entire Agreement
These Terms together with the Privacy Policy constitute the entire agreement between you and GolfTrip LLC.
